The paper aims to analyse law no. 112/2016, three years after its approval. Thus, its purpose is to consider this law against the background of the cultural and social process of emergence of a social model of disability. Under this model, “disability” is the result of an interaction between a person’s health condition, environmental and social factors. This is the approach on which ICF is based, one of the classification tools of the WHO (2001), referred to by law n. 112. At the same time, the paper intends to make some points on the reframing of the dominant conception of the human being and its intrinsic vulnerability. Starting from the concept of capacity mentioned in the UN Convention on the Rights of Persons with Disabilities, the paper will interpret some of the tools regulated by law no. 112.
