The article provides an in-depth analysis of the judgement delivered by the Italian Court of Cassation following a request for revocation of an expulsion decision, in order to grant a migrant the subsidiary protection status. On the one hand, the authors show the substantial interests of the prisoner behind the seemingly procedural issue of obtaining a prompt revocation of the expulsion decision. On the other hand, while the judgement is deemed to be correct as to the result, the authors strive to bolster a principled and systematic reconstruction of the applicable national and international law, at the intersection between immigration law, refugee law (esp. law of the subsidiary protection), criminal law.
